PROPOSED CONSTRUCTION OF NEW MAGSAYSAY BRIDGE PROJECT

Invitation to Apply for Eligibility and to Bid (IAEB)

The Subic Bay Metropolitan Authority (SBMA), a Government Corporation created under the Laws of the Republic of the Philippines wishes to invite bidders for the Proposed Construction of New Magsaysay Bridge Project which is located within the Subic Bay Freeport Zone (SBFZ).

The proposed project will consist of but not limited to the following Scope of Work:

1. Construction of a 4-lane concrete bridge with covered sidewalk on bored pile foundation and with Asphalt Concrete approaches;

2. Construction of Security covered gate, asphalt road with pavement markings, street lights and landscaping;

3. Construction of security outpost, steel gates and fences;

4. Installation of traffic signals and road signs; and

5. Other related works like relocation of utilities, demolition and disposal of existing bridge, structures, etc.

The Approved Budget for the Contract (ABC) IS Php 300 Million and will come from the allocated funds of SBMA Corporate Budget for the fiscal year 2009.

Interested Bidders must submit their Letter of Intent on or before 13 and 14 of July 2009 from 8:00 A.M. to 5:00 P.M. to:

And secure the Eligibility Documents therefrom, upon payment of a non-refundable fee of Php10,000 to the SBMA Treasury Department. The Eligibility Document shall be received personally by the Interested Bidders or his duly authorized representative upon presentation of the LOI, original copy of valid contractor's license by PCAB and submission of certified true copy. Applications for Eligibility will be evaluated on a non-discretionary "pass/fail" basis. The last day for the submission of the accomplished Eligibility Documents shall be on 17 August 2009 up to 5:00 P.M. only at the above address.

The date and time of opening of IAEB/Eligibility check is 9:00 A.M. of 18 August 2009 at Engineering Conference Room, 2nd Floor, Bldg. 255, Barryman Road, Subic Bay Freeport Zone.

Only those Bidders passing the eligibility check will be entitled to purchase the Bidding Documents.

Minimum Requirements for Eligibility of the Interested Bidders:

1. Technical Requirements

a) The bidder must possess a valid Philippine Contractors Accreditation Board (PCAB) license and registration with the following Minimum Requirements:

For Joint Venture, each partner of a Joint Venture (JV) must have a valid license and Registration issued by the Philippine Contractors Accreditation Board (PCAB) and one of the partner(s) must meet the above minimum requirements.

b) Contractor's Work Experience (Track Record)

The Contractor's General Experience (Track Record). The Applicant shall meet the following minimum Criteria:

1) Annual turnover for the last five (5) years of Php100 Million equivalent.

2) Successful Experience as Prime Contractor in the execution of at least three (3) projects of a nature and complexity comparable (similar) to the proposed project within the last five (5) years.

2. Financial Document

a) The prospective Bidder's audited financial statements for the past five (5) years, stamped "received" by the Bureau of Internal Revenue (BIR).

b) Prospective Bidder's computation of its Net Financial Contracting Capacity (NFCC) or at the Bidder's option a commitment from a licensed bank to extend a credit line, in the event of an award in the Bidder's favor, or at the Bidder's option a cash deposit certificate, of not less than the amount of the 10% of the ABC.

3. Legal Documents

Applicants, including each of the partners of a Joint Venture, should submit the following information:

a) Certified True Copy of Securities and Exchange Commission (SEC) registration certificate.

b) Certified True Copy of valid and current Mayor's Permit / Municipal License.

c) Certified True Copy of Taxpayer's Certificate of Registration from the Bureau of Internal Revenue (BIR).

d) Current Sworn Statement of the prospective Bidder that it is not "blacklisted" or barred from Bidding by the Government of any of its agencies, offices, corporations of LGUs, including non-inclusion in the Consolidated Blacklisting Report issued by the GOP.

e) Clearances from the Social Security System (SSS), Philhealth, PAG-IBIG and Department of Labor and Employment (DOLE).

f) Partnership duly organized under laws of the Philippines and of which at least seventy five percent (75%) of the interest belongs to the citizens of the Philippines.

g) Corporations duly organized under laws of the Philippines and of which at least seventy five percent (75%) of the outstanding capital stocks belong to the citizens of the Philippines.

4. Bidding will be conducted through open competitive bidding procedures as specified in the Implementing Rules and Regulations Part A (IRR-A) of Republic Act 9184, otherwise known as the "Government Procurement Reform Act" and is restricted, unless otherwise stated, to organizations with at least seventy-five percent (75%) interest or outstanding capital stock belonging to citizens of the Philippines. Only Bids from eligible Bidders will be opened. A contract will only be awarded to the Lowest Calculated and Responsive Bidder who was determined as such during post-qualification.

5. A complete set of Bidding Documents may be purchased by Bidders that passed the eligibility check upon the presentation of the Notice of Eligibility to the BAC Secretariat, at SBMA Engineering Department Room 230, Bldg. 255, 2/F Barryman Road, Subic Bay Freeport Zone and upon payment of a non-refundable fee of Php 60,000.00. The Bidding Documents shall be received personally by the bidder or his authorized representative on or before the time and date as indicated on the Notice of Eligibility Letter.

6. Completion of the Works is required within Three Hundred Sixty (360) calendar days.

7. While the Subic Bay Metropolitan Authority (SBMA) is open to all applications from qualified parties, SBMA reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract, in accordance with IRR-A Section 41 Reservation Clause of R. A. 9184 without thereby incurring any liability to the affected bidder or bidders.
